Government officials cannot censor a particular group because they do not like the message it wishes to express. Nor can it accomplish the same goal using discretionary fees. The university claimed it charged the security fee of over $5,000 because it feared protests from other students, but that violates the First Amendment. It amounts to a heckler’s veto, effectively punishing the speaker by charging fees it cannot afford because the group’s opponents might misbehave. And as it turned out, the university’s fears were unfounded, because Student for Life’s event went off without a hitch. Alliance Defending Freedom attorneys issued a letter to UNM explaining that the $5,461.40 security fee it issued to its Students for Life chapter violated the group’s freedom of speech.
