"It was obvious to us from the very beginning that the judge would reject our claims, although we used this stage in order to shed light on (the fact) that the real case is occupation versus people struggling against occupation, a state against an individual, Marwan Barghouti is a Palestinian, belongs to the Palestinian people who are calling for their freedom and that is what we used in this case."

"Barghouti is charged in this case with crimes that were committed in Israel where the victims were Israeli civilians and where the aim was to try and terrorise the Israeli public. In those circumstances the court decided that it was clear that it had jurisdiction to put Barghouti on trial."

STORYLINE:
Rejecting a defence motion, an Israeli court ruled on Thursday that it has the right to try Marwan Barghouti, a prominent leader of the Palestinian uprising.
Barghouti's defence lawyers had argued that their client should have immunity as a member of the Palestinian parliament and that he was snatched illegally by Israeli troops from a West Bank home eight months ago.
However, Israel says Barghouti helped finance the Al Aqsa Martyrs' Brigade, a militia linked to Yasser Arafat's Fatah movement, and that he played a role in the killings of 26 Israelis.
Barghouti appeared briefly in a Tel Aviv district court. He was led shackled into court in brown prison uniform as he entered.
Barghout's lawyers said he should be considered a prisoner of war, rather than a criminal defendant.
In ruling against the defence, Judge Garfinkel cited previous Israeli Supreme Court rulings, the Israeli penal code and the Geneva convention.
"Terror is not an act of war and therefore it does not fall within the rules of war," the judge said.
The judge ordered Barghouti held until the end of legal proceedings.
