[TOPIC 21] CONCEPT OF DONATION | Elements and Void Donations
Gratuitous transfers may be done during the lifetime of the donor, such as in the case of donacion inter vivos, or simply "gift". Like donacion mortis causa, donacion inter vivos is a transfer of property for free and without any consideration from the receiver of the property. But, the only difference between the two transfers is the timing of the transfer.
Donacion inter vivos has four elements to valid: 1) Capacity of the Donor, 2) Donative Intent, 3) Delivery of the Gift, and 4) Acceptance of the Donee. Please watch this video for more discussions.
