Now that a guilty verdict has been returned in the trial of Indiana v Richard Allen, many of us have lost faith in the process and are asking, what is the point of a jury trial? Did this happen because the Judge stopped the defense from presenting so much exculpatory evidence? Or is there a bigger problem here?
The concept of proving guilt beyond a reasonable doubt is debated, misunderstood, explained differently in different courts by different practitioners and the gravity of this decision may be lost on today's jurors.
