Alexander Hamilton famously described the National Judiciary as the “least dangerous branch.” Whether Hamilton was being disingenuous or not, his claim proved to be wildly wide of the mark.
The Judicial branch, with the Supreme Court at its apex, has crafted a seemingly unassailable position as referees, gatekeepers, and lawmakers. This three-session course will examine the emergence of judicial review, a selection of major Supreme Court decisions that reveal the arbitrariness of judicial review, and the futile attempts thus far to rein in the court’s power.
