Financial Requirement: The applicant's UK sponsor (usually the spouse or partner) must meet a minimum income threshold to sponsor a spouse or partner visa. The threshold was set at £18,600 per year for the sponsor alone, with higher thresholds for sponsoring dependent children (£22,400 for one child and an additional £2,400 for each subsequent child).
English Language Requirement: Applicants had to prove their proficiency in the English language. This could be done by passing an approved English language test or holding a degree that was taught in English.
Genuine Relationship Requirement: Applicants needed to provide substantial evidence to prove that their relationship with their UK spouse or partner was genuine and subsisting. This included documentation such as photographs, communication records, and cohabitation proof.
Accommodation Requirement: The sponsor had to demonstrate that they had adequate accommodation for themselves, the applicant, and any dependents without relying on public funds.
Probationary Period: Initially, spouses or partners were granted leave to remain for 2.5 years. They needed to apply for a further 2.5-year extension before they could apply for indefinite leave to remain (ILR), making the total probationary period five years.
No Recourse to Public Funds: Spouse visa holders were not entitled to access public funds and had to be financially supported by their sponsor.
Application Fees and NHS Surcharge: There were fees for applying for a spouse visa and an additional NHS surcharge that applicants had to pay to access the UK's National Health Service.
